Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Touch of Modern Interiors website (the “Service”) operated by Touch of Modern Interiors (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Touch of Modern Interiors and its licensors. The Service is protected by copyright, trademark, and other laws of both the Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Touch of Modern Interiors.
2. Orders and Payments
a. **Orders:** By placing an order with Touch of Modern Interiors, you agree to provide accurate, current, and complete information about yourself and your requirements. We reserve the right to refuse or cancel any order.
b. **Payment:** All payments are due upon receipt. If a payment is not received or payment method is declined, the order will not be processed or shipped.
3. Delivery and Installation
a. **Delivery:** We will make every effort to deliver your kitchen cabinets within the agreed-upon timeframe. However, we are not responsible for delays beyond our control, such as unforeseen manufacturing issues or shipping delays.
b. **Installation:** Unless otherwise specified, installation is not included in the purchase price. We can provide installation services for an additional fee.
4. Returns and Refunds
a. **Returns:** We accept returns of defective or damaged products within 24 days of delivery. Please contact us for return authorization before returning any products.
b. **Refunds:** Refunds will be issued in the original form of payment upon receipt and inspection of returned items.
5. Limitation of Liability
Touch of Modern Interiors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
